The upcoming Shale Gas Drilling Operations (Fracking) Conference, presented by HB Litigation Conferences in conjunction with West LegalEdcenter, will offer lawyers insight into key issues surrounding fracking lawsuits.  Attorneys will have the opportunity to reflect on Daubert issues related to personal injury and property damage claims.  The discussion will be led by Attorney John Spillane of the Nemeroff Law Firm, Dallas, TX, along with panelists John Kind, PhD, and John McAleese, III, of Morgan, Lewis & Bockius LLP, Philadelphia, PA.

Some questions to be considered include:

• What evidence are plaintiffs likely to rely upon to prove their claims?
• What are defendant’s likely strategies to attack?
• What roles will regulatory limit play in these cases?

Google's 2-step verification is a MUST for Gmail account users

8/14/2012

Some of you may have read Matt Honan's sad tale of the massive data loss he experienced after hackers targeted his Twitter account which linked to his personal website and gmail account and wiped out everything they could access from there.  Honan had unfortunately daisy-chained several accounts together (Amazon, Apple, twitter, etc.) in a way that created a security gap.

One step Honan could have taken to limit his exposure would be to activate google's two-step verification.  This form of verification requires a user to have access not only to his username and password, but also to a cellphone or land line to receive a confirmation code.  For more information on how to set-up two-step authentication, check out Google's blog here.

In response to the press created by this security breach,  Apple has suspended over-the-phone password resets and Amazon closed a security gap where users could access account information over-the-phone after providing only a name, address and e-mail

Chesapeake struggles to sale properties in Michigan

Chesapeake has been in a race lately to sell off assets in order to continue funding its operations.  The company has met some challenges in finding a profitable sale of acreage in Michigan.  On Thursday, Chesapeake confirmed it is the subject of a Justice Department investigation which suggests possible criminal antitrust violations related to how it acquired land in Michigan.

According to Reuters writers, Anna Driver and Joshua Schneyer, Chesapeake spent around $400 million to acquire 450,000 acres in the northern part of the state.  Prior to antitrust allegations, the sale of the acreage was projected to bring in $500 million.

The antitrust violations stem from alleged efforts by Chesapeake, and its rival Encana corp., to  keep prices low in the Collingwood shale.

Last week at the American Bar Association's Annual Meeting in Chicago, IL, I spoke on a panel along with two outstanding colleagues, Jeffrey Allen and Catherine Sanders-Reach.   The program was well attended and, as always, a lot of fun to participate in.  The CLE was part of the ABA's Solo Day.

This week, Attorney at Work highlighted excerpts from the presentation in their daily dispatch e-mail, The Friday Five.  The website, Attorney At Work is published by a small group of law practice management experts, designed to provide you with valuable practice information.

As a bonus tip, Attorney At Work also highlighted the new ABA Solo and Small Firm Resource Center.  The resource center is a hub for marketing, technology,  practice management, CLE & substantive law resources.  It is designed to replace your homepage and provide a wealth of law practice tools at your fingertips.

I truly enjoy presenting on the subject and if you are looking for a CLE instructor on similar topics, please feel free to contact me.
