In particular, cloud storage, which offers lawyers the ability to save their data and client files in an Internet-based storage system, has been a welcome advancement. Rather than store data on a local drive, cloud storage providers store information in one of their remote data centers that lawyers can then access from almost anywhere. This increases the range of accessibility for lawyers and their clients. The technology is particularly useful for lawyers using iPads in their practice who may get frustrated trying to access client files without a USB port. Cloud storage can bridge together all the devices commonly used in practice today, making it easy to transfer files between computers, laptops, iPads/tablets, and smartphones.

The decision came out of the Eastern District of Texas and was upheld by the U.S. Court of Appeals - 5th Circuit in New Orleans. It stems from an agreement made in July 2008 to purchase deep rights held by Peak in leases out in the Haynesville Shale area. The purchase price was set at $15,000 per acre. When gas prices took a dive, though, Chesapeake refused to honor the agreement.
Chesapeake argued the agreement was unenforceable under the Texas Statute of Frauds, fatally indefinite and that Peak had failed to tender performance. The Court disagreed.
